Man "attacked" by Marlin? I would revise the choice of words. Given the fact that the "attacking" marlin was actually being pulled out of its habitat by a fairly large hook in its mouth, I would say that he was simply defending himself.

If I were the one being hauled into water by a hook in my mouth, I would fight back too.

Oh, if only Johnny Cochrane were still with us to defend this poor marlin. "If the sword doesn't fit, you must acquit!"
